Can I switch to a UK Spouse Visa without leaving the UK?
Yes, if you already have valid permission to stay in the UK under a route that allows switching — such as a Skilled Worker visa, Student visa (with more than six months remaining), Graduate visa, Youth Mobility Scheme visa, or Fiancé(e)/Proposed Civil Partner visa. You generally cannot switch if you are in the UK as a Standard Visitor, Marriage Visitor, on a short-term Student route, or have six months’ leave or less remaining (except fiancé(e)s and proposed civil partners, who have a specific exception).
Who Can Switch to a Spouse Visa In-Country
Under Appendix FM of the Immigration Rules, you can normally apply to switch into the partner route from inside the UK if you currently hold valid leave as, for example:
- A Skilled Worker
- A Student (on a route granted for more than six months)
- A Graduate visa holder
- A Youth Mobility Scheme visa holder
- A Global Talent, Innovator Founder, or Scale-up visa holder
- A Fiancé(e) or Proposed Civil Partner visa holder, after marrying or forming a civil partnership in the UK — this is a specific, named exception to the six-month rule below

Who Cannot Switch In-Country
Under paragraph E-LTRP.2.1 of Appendix FM, you cannot normally apply to switch into the partner route if you are in the UK:
- As a Standard Visitor or on a Marriage Visitor visa (even if you marry your partner during your visit, you must leave the UK and apply for entry clearance as a spouse from your home country)
- With permission granted for six months or less, other than the fiancé(e)/proposed civil partner exception above
- On a Seasonal Worker visa
- As a Domestic Worker in a Private Household
- As the parent of a Child Student
- Without any valid leave (an overstayer), other than in limited human rights circumstances
If you fall into one of these categories, the standard route is to leave the UK and apply for entry clearance as a spouse from abroad, meeting the same requirements. Trying to switch when you are not eligible almost always results in refusal and can affect your future immigration history.

The Fee and What You’re Granted
The in-country switching fee is different from the entry clearance fee paid by applicants applying from abroad — see our full UK Spouse Visa Cost 2026 guide for the exact current figures, since Home Office fees change periodically (most recently on 8 April 2026) and we keep that page updated with the live amount.
If your in-country switch is successful, you are normally granted an initial period of 30 months, rather than the 33 months given to applicants who apply from outside the UK. You will then need to extend for a further 30 months via the FLR(M) process — see our Spouse Visa Extension (FLR(M)) guide — before reaching the five-year point required for Indefinite Leave to Remain.
The Financial Requirement When Switching
One rule catches many applicants out: for a first-time application made from outside the UK, only the UK-based sponsor’s income can normally be counted. But if you are switching from inside the UK, and you already hold permission to work, your own UK employment income can be combined with your sponsor’s to help meet the £29,000 threshold. Timing: Apply Before Your Current Visa Expires
You must submit your switching application before your current leave expires. If you apply in time, your existing conditions and rights (including the right to work, where applicable) normally continue under Section 3C leave while the Home Office makes its decision — but you must not travel outside the UK while the application is pending, as doing so ends your Section 3C leave and can cause the application to be treated as withdrawn.
If your current visa expires before you submit your switching application, you become an overstayer. This significantly complicates your position and, depending on the length and reason for the gap, may mean you are no longer eligible to switch at all.
